Terms of service

These Terms of Service govern your use of bornloyalclo.com and any purchase you make from it. The site is operated by BornLoyal Clo, based in Cyprus. By using the site or placing an order, you agree to these terms.

Eligibility

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order.

Products

  • Our garments are produced in limited runs and are not restocked. Once a drop has sold out or its window has closed, that piece will not be produced again.
  • We make every effort to display colours and details accurately, but screens vary and slight differences between the images and the delivered item are normal.
  • Garments involving print, knit or embroidery may show minor variation between individual pieces. This is a characteristic of the production method, not a defect.
  • Sizes are given as garment measurements in our size guide. Please check them before ordering.

Orders and acceptance

  • Your order is an offer to buy. The order confirmation email acknowledges receipt but does not constitute acceptance.
  • A contract is formed only when we dispatch the goods or, in the case of a pre-order, when we confirm that your item has entered production.
  • We may decline or cancel an order — for example if an item is unavailable, a production run cannot be completed, there is a pricing or description error, or we suspect fraud. If we cancel, we refund you in full.

Pre-orders

  • A pre-order reserves an item from a limited production run that has not yet been manufactured.
  • Payment is taken at the time of order unless stated otherwise at checkout.
  • The estimated dispatch time is shown on the product page before purchase. By placing a pre-order you accept that dispatch may take place more than 30 days after your order, in line with that estimate.
  • Estimates are given in good faith and may change if manufacturing or shipping is delayed. We will keep you informed by email.
  • If dispatch will be more than two weeks later than the estimate, we will contact you and offer a full refund or a discount on a future drop.
  • You may cancel a pre-order at any time before dispatch for a full refund.
  • Where a drop is subject to a minimum production threshold, this will be stated on the product page. If the threshold is not met, all affected orders are refunded in full.

Pricing and payment

  • Prices are shown in EUR and include all applicable taxes and duties. Where local currency display is enabled, the amount charged is converted at checkout.
  • We may change prices at any time, but changes do not affect orders already placed.
  • If a product is listed at an obviously incorrect price, we may cancel the order and refund you in full.
  • Payment is processed by our payment provider. We do not store your full card details.

Shipping, returns and refunds

Delivery, cancellation, returns and refunds are governed by our Shipping Policy and Refund Policy, which form part of these terms.

Intellectual property

All content on this site — including the BornLoyal name, logos, garment designs, artwork, photography and text — is owned by us or our licensors and protected by intellectual property law. You may not reproduce, distribute or use it commercially, including reproducing our designs or artwork, without our written permission.

Acceptable use

You agree not to use the site unlawfully, attempt to gain unauthorised access to it, interfere with its operation, or use automated systems to place orders or scrape content.

Liability

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under applicable law, including your statutory rights as a consumer. Subject to that, our total liability in connection with an order is limited to the amount you paid for it, and we are not liable for indirect or consequential loss.

Force majeure

We are not liable for delay or failure to perform caused by events beyond our reasonable control, including manufacturing disruption, carrier failure, customs delays, natural events or industrial action. Where such an event causes significant delay, you may cancel and receive a full refund.

Governing law and disputes

These terms are governed by the laws of the Republic of Cyprus, and the courts of Cyprus have jurisdiction. If you are a consumer resident elsewhere in the EU, you keep the protection of the mandatory consumer laws of your country of residence.

EU consumers may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

Changes to these terms

We may update these terms from time to time. The version in force when you place an order is the version that applies to it.
